As the legal owner of Airfel brand Daikin Isıtma Ve Soğutma Sistemleri San. Tic. A.Ş. ("Daikin"), we aim to protect the privacy of our members using our website in order to allow them to benefit from our services in a safe, secure and complete manner. Accordingly, this Privacy Policy (“Policy”) has been prepared to ensure that the personal data of our members are processed in strict compliance with the Law no. 6698 on Protection of Personal Data (“Law”) and to inform our users in this context.
 
The purpose of this Policy is to set forth the terms and conditions regarding the personal data shared with Daikin by the Platform members/visitors/users (collectively referred to as the “Data Subject”) during the operation of the website with domain name www.airfel.com.tr and the mobile application (collectively referred to as the “Platform”) or the utilization of such personal data processed by Daikin during the use of the Platform by the Data Subject.
 

Which Data are Processed? What is the Purpose of Processing of Personal Data?

 
We process some of your data that may directly or indirectly identify the user, including, without limitation, your name, surname, e-mail address, phone number, gender, date of birth, Turkish identity number, tax identity number, personal areas of interest, billing and delivery addresses; and the information approved to be shared through social media channels if you connect via your social media accounts, etc. in order to provide better services to our users; to conduct and conclude your ordering processes and to ensure the relevant communications with you; to inform you about products, services, campaigns, and promotions; to better understand your shopping preferences, to make trend analyses and statistical analyses, and to reinforce the security of the Website; and to fulfil our legal obligations arising from the relevant legislation, including, without limitation, the Law No. 5651 on Regulating Broadcasting in the Internet and Fighting Against Crimes committed through Internet Broadcasting, the Law No. 6563 on Regulation of Electronic Commerce, Turkish Criminal Code No. 5237, and the Law No. 6698 on Protection of Personal Data as well as the secondary legislation issued under the relevant laws.
 
In addition to these data, we also collect and process collective statistical data not containing personal data such as the Website visit frequency and times, the ordering times and the IP address at the time of placement of the order, and the statistics of product pages visited and the products ordered, etc. in order to analyse and understand visitor movements and preferences. We process and store such personal data with reference to your explicit consent in order to allow you to benefit from the services that we provide on the Website, also by taking appropriate information security measures, provided that they are not used for any other scope and purposes except for those specified in this Privacy and Cookies Policy.

 

We use some of your data that we collect in the database for periodic campaigns that will be sent at regular intervals, for the design of special promotional activities for customer profiles, and for customer classification efforts to prevent the transmission of undesired e-mails or spams in compliance with the relevant legal regulations. When you use a credit card to pay for the price of a product, you accept and agree that your credit card number, the expiration date and CVV2 code of your credit card and other similar information will be shared with banks. Nevertheless, the details of credit cards and/or bank debit cards used during creation of an order are not stored in our systems under any circumstances. Daikin is free to store any and all records pertaining to terminated membership accounts providing that they are duly anonymised.
 
When anonymised, data lose their property of identifying a specific person and, in this sense, they are not any longer considered as personal data. No member may claim for any rights or damages in relation to the records that have been anonymized. We can share your personal data with third parties that we cooperate with in order to provide our services (with the companies providing the services such as cargo/courier, shipment, call center, database, etc.) and with governmental authorities as required by our statutory obligations.
 
Daikin may share your personal data related with your visits to the Website and the traffic data like your navigation details with governmental agencies and institutions that are legally authorized to request such information for the purpose of your security and for fulfilment of the obligations under applicable laws. However, we will neither use your personal data for any commercial purposes nor share them with any other third persons except where required pursuant to the relevant legislation and in relation to the aforementioned activities.
 
Your personal data may, from time to time, be directly or indirectly transferred to our domestic or foreign shareholders, our affiliates and/or subsidiaries; and any other domestic or foreign institutions and other third persons from which we receive contractual services or with which we cooperate in order to conduct our activities.
 

What are the Rights of the Owner of Personal Data?

Pursuant to article 11 of the Law; data subjects have the following rights:

  • To learn whether any of their personal data has been processed, and if yes, to request information regarding such processing;

  • To learn the purpose of processing of their personal data and whether their data have been used for intended purposes; and to know/learn the third parties to whom their personal data have been transferred at home or abroad;

 

  • To request for correction of their personal data if they have been processed incompletely or inaccurately, and to request for notification of any actions taken in this regard to the third persons to whom their personal data have been transferred;

  • To request for erasure/deletion or destruction of their personal data in case the reasons requiring the processing of their personal data cease to exist even if they have been processed in accordance with the Law and the provisions of other relevant laws, and to request for notification of the actions taken in this regard to the third parties to whom their personal data have been transferred;

  • To object to the analysis of their personal data processed, exclusively by automated means or systems, which leads to an unfavourable consequence for them, and to request compensation for any loss or damage that may arise from the unlawful processing of their personal data.

 
The requests for the exercise of such rights may be submitted by the Data Subjects through the methods specified in the Privacy Policy provided on the Website. Daikin shall conclude such requests within thirty days. Daikin reserves the right to charge a fee based on (if any) the fees tariff determined by the Personal Data Protection Board in relation to such requests.
 

How Long are Personal Data Stored?

 
Pursuant to the Law No. 6563 on Regulation of Electronic Commerce; any and all records regarding the withdrawal of the consent shall be stored for 1 year from this date; and any and all records regarding the contents of the commercial electronic message and all other records related with the posting shall be stored for 3 years for any future submission to the relevant ministry when necessary. After the expiry of these periods, your personal data shall be deleted, destroyed or anonymized by our company or upon your request.

Any information relating to a specific or identifiable person is Personal Data. Accordingly, in order to be able to define Personal Data, the data must be related to a natural person and this person must be specific or identifiable. Data that determines the location of the personal data owner while using any tool or application belonging to Daikin, such as GPS location, travel data, can be considered Location Data. Location Information, which is automatically shared by the customer in case of acceptance of the use of any tool or application belonging to Daikin, is processed under the conditions specified below.
 
Location Information, as also specified in the Daikin Personal Data Protection Policy, can only be processed to provide technical service to the Customer, to deliver or assemble the products, to provide a complete service to the customer, in order to fulfill the obligations arising from the contractual relationship between our Company and our Customer and to fulfill other legal, administrative or contractual obligations, within the scope of the personal data processing conditions specified in the 5th and 6th Articles of the Law for the purposes numbered in the Daikin Personal Data Protection Policy. Location information can be collected if the Customer choose to use Automatic Control feature at The product and share that information. The Customer may set up app to turn off the Product when he is not at home. For this it is needed to share the location of customer mobile device with us.
 
Daikin undertakes to take the necessary technical and administrative security measures in order to prevent the processing and access of personal data by unauthorized persons in accordance with Article 12 of the Law on the Protection of Personal Data. In this context, information security controls are also taken as a basis and operated within the scope of the protection of Personal Data.
 
In order to ensure the security of Personal Data, controls within the framework of physical and environmental security are improved at all locations where Daikin operates, and awareness programs are prepared, which focus on the duties and responsibilities of employees and suppliers regarding the protection of Personal Data. In addition to administrative methods, importance is given to the implementation of technical security controls. In this context, authorization and approval mechanisms are established for all kinds of access, they are regularly reviewed and the transactions made are recorded, periodic audits are carried out to determine the vulnerabilities that may occur in the systems, cryptographic methods are used to prevent unauthorized access during the transfer of data, risk for security events that may occur analyzes are carried out and security events that occur are recorded and resolved.
 
Circumstances of personal data collection:
 
We will collect your personal data under the following circumstances:

Company will handle all types of personal information, including the data clearly provided by you and your device data and personal information generated from the use of our services, specifically:
 
• When you register or log in, we will collect your email address, password, nickname, and profile photo that you use in registration.
 
• When you download or use the app, Company may read information about your mobile device, such as information of the hardware model, IMEI number or other unique device identifier, MAC address, IP address, operating system version, and location. The Company may also read information about the use of your appliances through Airfel Scala app or any other IoT app, such as the device model, operating status, frequency of usage, and the speed of the fan, the temperature degree. The Company may also receive and record information about your conversations, audios, videos, pictures, etc. in voice.
 
• When you use bonded and controlled devices, we will collect the information of location of the device, IP address, user name, current location data, and timer function. We collect your location information, not track your whereabouts, open the location service can directly obtain your location information to provide you with services.
 
• When you use a product or service, the Company will automatically receive and record information about your browser and computer or App client, such as your IP address, browser type, language used, and access date and time, hardware and software feature information and web page records you need; when you apply for after-sales service, the Company may also collect your phone number and address.
 
Your Personal Data will be collected electronically by automated means through the recording of webinars that you will register and/or attend to, and will be stored by Daikin for the period stated in the Daikin Personal Data Protection Policy.
 
Your Personal Data will be processed based on the explicit consent that you have given in accordance with paragraph 1 of Article 5 of the KVKK.
 
In accordance with KVKK article 7, personal data must be deleted, destroyed or anonymized if the reasons for processing are eliminated. In cases where the processing of personal data is carried out only on the basis of express consent, the data subject's withdrawal of consent, the acceptance by the data controller of the personal data processing activity within the framework of the rights of the data subject in subparagraphs (e) and (f) of Article 11 of the Law, and the storage of personal data. Despite the expiry of the maximum time required, destruction will be ensured in cases where there is no condition to justify keeping the personal data for a longer period of time.
